GENERAL TERMS AND CONDITIONS FOR PRIVATE BOAT TOURS

1. PURPOSE
These terms and conditions govern the booking of private boat tours and excursions offered by Seamallorcatrips.
By making a reservation, the user expressly agrees to these terms and conditions.
2. BOOKINGS
The tours are private, in accordance with applicable regulations in the Balearic Islands.
No individual seats or single tickets are sold.
Bookings can be made via website, external system (Turitop), WhatsApp, or telephone.
The booking is only confirmed once payment has been received.
Each reservation grants exclusive use of the boat for the client’s group on the selected date, preventing its sale to other customers.
3. PRICES AND PAYMENT
Prices refer to the full rental of the boat, not individual seats.
The price may vary depending on the number of people in the group.
This variation is due to operational factors such as:
higher fuel consumption
increased load on the vessel
greater wear and logistical requirements
Payment to secure the selected date must be made at the time of booking using the available methods.
4. CANCELLATION AND REFUND POLICY
The cancellation conditions and total price are provided before payment. For voluntary customer cancellations, the agreed non-refundable rate applies only insofar as permitted by applicable consumer law. Nothing in these terms excludes mandatory refund rights.
If the operator cannot provide the booked service, a change of date or an equivalent alternative may be offered for the customer to accept. If no alternative is agreed, payments for services not provided will be refunded as required by applicable law. A customer is not required to accept a voucher in place of a legally due refund.
5. SAFETY REQUIREMENTS
For safety reasons, this activity is not suitable for:
Persons over 120 kg
Pregnant women
Children under 5 years old
Persons with reduced mobility or access difficulties
Persons over 70 years old
The user declares, under their own responsibility, that they meet these requirements at the time of booking.
The client must provide accurate information. The skipper retains responsibility for applicable boarding and safety checks; the customer declaration does not replace those duties.
6. USER OBLIGATIONS
The user agrees to:
Provide truthful and complete information at all times
Comply with the stated safety requirements
Follow crew instructions at all times
Refrain from consuming alcohol or substances that may compromise safety
7. LIABILITY
Participants must follow the safety instructions. Nothing in these terms excludes the operator’s liability for its own negligence, failure to perform, or any liability that cannot lawfully be excluded.
The circumstances of any incident and responsibility will be assessed under applicable law, including whether it was caused by:
failure to comply with safety rules
inadequate physical condition of the user
false or incomplete booking information
consumption of alcohol or substances
The skipper may refuse boarding when necessary for safety. Any cancellation charge or refund will be assessed according to the circumstances, the information provided before booking and mandatory consumer rights.
Duration: 2.5 hours, including sailing, swimming and return to Port d’Alcúdia. The displayed route is illustrative; weather, sea conditions and available time determine the points reached and stops made. Not every stop is guaranteed.
8. MODIFICATIONS
Schedules, routes, or conditions may be modified for safety reasons, weather conditions, or force majeure.
9. MINORS
Minors must be accompanied by a responsible adult at all times.
10. APPLICABLE LAW
These terms are governed by Spanish law.
Disputes are subject to the courts determined by applicable law, preserving the consumer’s right to the legally competent court.
